Product Terms and Conditions

For hirers posting ads purchased as part of an Ad Pack or Monthly Subscription (as described below), PART A of these terms applies to you.
For hirers i) posting ads pursuant to a SEEK Advertising Agreement which includes a Job Ad Budget (either a Flexible Ad Budget or a Branded Ad Budget) as part of a SEEK Advertising Agreement commencing from 1 December 2019; or ii) purchasing a casual ad (i.e. a single ad not purchased under a SEEK Advertising Agreement) , PART B of these terms applies to you.

PART A

The following Terms are applicable only where you have purchased an Ad Pack or a Monthly Subscription and are posting ads from one of those products:
Job Ads
  1. All job ads posted on the SEEK website (the Site) remain posted for 30 days (unless removed earlier) and can be edited free of charge or, subject to relevant charges, extended.
  2. You are obliged to pay the full fee for each job ad, even if you request the withdrawal of your ad at any time (whether before or after it appears on the Site).
SEEK Ad Types
  1. Classic Ads
    1. A Classic Ad is SEEK’s standard job ad. A Classic Ad entitles you to
      1. when a Classic Ad is included within a candidates’ search results, the relevant role title for the ad and a brief description of the position you are advertising being displayed to candidates; and
      2. when selected by a candidate from SEEK’s search results, the full contents of the job ad being displayed to the candidate.
    2. From time to time SEEK may repost your Classic Ad on the website/s of its related bodies corporate to increase the exposure of your ad.
  2. StandOut Ads
    1. A StandOut Ad listing entitles you to the features of a Classic Ad listing plus the following when a StandOut Ad is included within a candidates’ search results when your ad is returned within those results:
      • up to three Text points - “selling points”;
      • your logo at the right-hand side of the ad (provided you have submitted an electronic version of your logo for those purposes); and
      • a border around the ad summary when it appears in the search result (defined as a “StandOut Ad”).
    2. You must provide SEEK with the necessary materials and information (outlined above) required to publish the StandOut Ad on the commencement date of the ad. Failure to do so will result in the ad being published as a Classic Ad but you will be charged the StandOut Ad price.
    3. SEEK reserves the right to withhold publication of any logo in the search results where SEEK reasonably believes that the creative design is not a logo or is otherwise not appropriate for posting on the Site.
    4. All logos must comply with SEEK’s advertising specifications, which will be provided on request.
  3. Premium Ads
    1. A Premium Ad listing entitles you to the features of a Standout Advertisement plus the following increased exposure of your ad.
    Premium Ad Performance:
    1. During the period that a Premium Ad is live on the Site SEEK takes various measures to increase the exposure of your Premium Ad with the aim of obtaining on average more applications which would be received for your ad over a 30 day period if it was a StandOut Ad. Such measures may include but are not limited to ads appearing more frequently on the job search results page on the Site and App, in email communications to relevant candidates and on partner sites such as Jora. You acknowledge that the promotion measures employed by SEEK, and the frequency of that promotion are at SEEK’s sole discretion.
    2. Whilst Premium Ads receive greater exposure on the Site than other SEEK job ads, SEEK provides no guarantee and makes no representation that a Premium Ad will result in an increase in the number of applications received in response to that Premium Ad, and you acknowledge that application levels are influenced by many factors beyond the control of SEEK.
    Premium Ad Pricing:
    1. Premium ads are variably priced based on a number of factors, including candidate availability, hirer demand and the location for the role advertised. Changes to these factors, amongst other things, may cause the price of a particular job ad to go up or down from time to time.
    2. Once purchased, your Premium Ad can be edited free of charge. If you edit the category and/or location of your ad, you acknowledge that the market conditions (on which SEEK will have based the promotion strategy applicable to the ad) will likely change and that this may affect the number of applicants your ad will receive.
Ad packs
  1. All Ad Packs (“Packs”) are valid for 6 months from the date you post the first ad from the Pack or until the total number of ads or dollar value of your Pack has been consumed (whichever is earlier).
  2. Please note that upon expiry of your Pack unless otherwise agreed, any further ads posted on the Site will be billed at SEEK’s then standard advertising rates.
A. Conversion Functionality
  1. If conversion functionality has been enabled for your Pack, subject to the rules for each Pack type in clause 22 below, you will be able to use your Pack to post a variety of different SEEK ad types up to the dollar value specified in your Pack.
  2. The cost to post each ad type will either be listed in your Advertising Agreement or communicated to you by SEEK to you at the time of posting an ad.
  3. The cost of the ad posted will be deducted from your Pack balance. Your Pack balance will be calculated by dollar amount remaining and will be listed in the SEEK Advertiser Centre and available from SEEK Customer Support.
  4. If you have the value of less than 1 full ad remaining in your Pack (i.e. you have a fraction of an ad remaining) as a result of a) utilising conversion functionality or b) consumption of a Premium Pack, you will be able to use this remaining dollar amount towards your next SEEK ad purchase (if made during the life of your pack). Any shortfall when making your next purchase will either a) be deducted from your next Pack, if you have already repurchased another Pack; or b) be invoiced to you separately. If, however, you have not used the full value of your Pack, (including a fraction of an ad) prior to the expiry date of your Pack, any remaining balance will expire.
  5. Subject to SEEK’s approval, by contacting SEEK conversion functionality can be switched off (SEEK will never deny a request to turn conversion functionality off).
  6. Your Advertising Agreement will specify whether conversion functionality has been turned on at the commencement of your Pack.
Ad Pack Types

B. Premium Packs and Posting Premium Ads
  1. In relation to Premium Ads and Premium Packs, if you have:
    1. A Premium Pack - the cost of any Premium Ads posted will be deducted from your Premium Pack balance.
    2. Conversion enabled (but no Premium Pack) - the cost of any Premium Ads posted via conversion functionality will be deducted from your active Pack balance.
    3. Both a Premium Pack and another Pack with conversion enabled - the cost of any Premium Ads posted will first be deducted from your Premium Pack balance.
C. StandOut Upgrade Pack
  1. If you purchase a StandOut Upgrade Pack, you can selectively upgrade Classic Ads to Standout Ads within the corresponding job classifications. A StandOut Upgrade Pack will expire on the earlier to occur of:
    1. 6 months from the date the first StandOut Upgrade is utilised; and
    2. The date that the total number of StandOut upgrades you are entitled to under the agreed StandOut Upgrade Pack have been utilised.
Monthly Subscriptions
  1. A Monthly (Job Ad) Subscription commits you to purchasing a minimum number of ads each month (“minimum monthly commitment”) over a 12 month period. For the avoidance of doubt, your specified limit per month refers to the total number of job ads that your Subscription allows you to post each month without having to pay additional fees and not the total number of concurrent job ads you may have listed at any one time.
  2. You will be billed on the 15th of each month for your minimum monthly commitment.
  3. Should you post ads in addition to your minimum monthly commitment, you will be charged the Additional Ad rates specified in your Subscription for each ad posted beyond your minimum monthly commitment and will receive an additional invoice on the 1st business day of the following month for any such extra costs incurred.
  4. You may request to increase your minimum monthly commitment by signing a Supplementary Agreement which will take effect from the commencement of the month following that in which the request was made.
Talent Search and SEEK Profiles
The Talent Search site allows advertiser to search, refine and connect with candidates via a candidate’s SEEK Profile in relation to advertisements placed on the Site.
  1. A SEEK Profile is created by a candidate and is a summary of information regarding their career and work history to which they may attach their resume.
  2. Your access to and use of Talent Search and information contained in SEEK Profiles is governed by the Talent Search Terms and Conditions which can be viewed at: Talent Search Terms and Conditions
  3. SEEK reserves the right to deny or remove your access to SEEK Profiles for what it determines in its absolute discretion to be improper or incorrect use.
Screen
Screen is a product that allows you to present a list of questions to applicants as part of their application process on the Site to assist you in candidate selection (“Screen”).
  1. Screen is available to attach to advertisements within the corresponding job classification(s). Any unused Screens purchased by you shall be forfeited at the expiry or removal of its associated advertisement.
  2. You may store your questionnaire in a library for future use however you must attach it to each advertisement you place on the Site and it will only work in conjunction with active advertisements.
  3. You are entitled to 5 Standard Screening Questions and 1 Custom Screening Question at no cost per Advertisement. No further Standard Screening Questions or Custom Screening Questions are able to be purchased through this service.
    1. A Standard Screening Question is one of the questions referred to as “Common questions” in the Screen.
    2. A Custom Screening Question is a question of up to 250 words that can be entered into the text box under “Your custom question” in the Screen.
  4. SEEK reserves the right upon amending clause 34 of these terms and conditions to charge a fee for Standard Screening Questions and Custom Screening Questions offered within the Screen Product. SEEK will provide notice of any such change by publishing the amended clause in these terms and conditions 5 days prior to the change taking effect.
Onsite
SEEK Onsite (“Onsite”) automatically replicates the advertisements you place on the Site on your own website.
Two options are available to you:
  • Job List - which provides a list similar to the SEEK “search results list” showing all available positions for your business. Suitable for businesses with up to 40 positions advertised. Jobs appear in date order.
  • Job Search - a Job Search box on your business’s website will help candidates narrow down their search and view only relevant ads. Fields available are Location, Work Type, Classification and Keyword. Suitable for businesses with more than 40 positions advertised.
  1. SEEK will provide you with:
    1. a URL or URLs that you will need to embed in your own website. Without this work on your part, the SEEK Onsite solution cannot be accessed by visitors to your website. If you have posted to more than one SEEK website you may have to implement multiple links on your website; and
    2. a “Powered by SEEK” logo which you must be place on your website adjacent to the job list or job search both in a position that is visible on an 800x600 screen without scrolling down (known as “above the fold”). You must not modify the logo in any way, including but not limited to resizing, recolouring, stretching or changing the background appearance.
  2. If you have more than one registered account with SEEK, you may link any of the advertisements posted under those accounts to the SEEK Onsite service. If you want to add new accounts to your Onsite service then you may be required to implement changes to the link or links on your website to implement this change. You will receive any new URL information from SEEK within three (3) business days of the formal request to SEEK.
  3. When you stop using Onsite you must also cease using works containing intellectual property belonging to SEEK on your website including without limitation, logos, symbols, emblems, designs and other indicia.
Templates
If requested by you, SEEK will create custom advertising templates in accordance with our style guide that will appear in your job advertisement (not in the search results) on the Site and will incorporate your logo (production charges apply).
  1. SEEK will use its reasonable endeavours to produce customised templates within three business days from receipt of your logos, graphics and text.
  2. SEEK reserves the right to withhold publication of any logo in the template if SEEK at its sole discretion believes that the creative design is not a logo or is not appropriate for posting on the Site. SEEK will not unreasonably exercise this right.
Display Advertising
Display advertising refers to SEEK’s offering to promote an advertiser’s message and/or creative design, surfaced through banners or other ad formats (consisting of text, images, html5 and video) (Display Advertising), on websites, apps and/or social media including but not limited to these platforms that are powered by the SEEK Group. In relation to your Display Advertising:
  1. SEEK reserves the right to withhold publication or remove any Display Advertisement if it believes at its sole discretion that i) the creative design; ii) the copy of the advertisement; or iii) the page to which the advertisement links to is a) not aligned to employment or career related services and/or; b) not appropriate for distribution by SEEK. SEEK will not unreasonably exercise this right.
  2. All Display Advertising must comply with SEEK’s advertising specifications, which will be provided on request.
  3. For the purpose of determining the consumption of contracted quantities of Display Advertising, consumption of impressions (and the like) will be calculated according to SEEK’s ad serving platforms

PART B

The following terms are applicable only where you have either:
  1. purchased and posted a casual; or
  2. purchased a Flexible Ad Budget or a Branded Ad Budget (each an Ad Budget) in your SEEK Advertising Agreement (Agreement):
Job Ads
  1. All job ads posted on the Site remain posted for 30 days (unless removed earlier).
  2. You are obliged to pay the full price for each job ad, even if you request the withdrawal of your ad at any time (whether before or after it appears on the Site).
  3. SEEK’s job ads are variably priced and prices are subject to change from time to time. For more information on the pricing of each ad type, see the clauses below.
  4. It is your responsibility to look up the price of a job ad before posting on the Site. The price of any particular job ad at a point in time may be looked up using the following link and your SEEK Advertiser Centre login details – https://talent.seek.com.au/account/ad-price-lookup.
    For Hirers purchasing ads via SEEK’s Advertiser Centre, the price will be displayed to you at the point of posting as part of your job ad posting process.
    For hirers purchasing ads via other means, the cost of a job ad may not be displayed at the point of posting if you are not using SEEK’s Advertiser Centre to post your ad and you should use the above link prior to purchasing if you wish to look up prices.
  5. When posting a single ad on the Site not pursuant to an Agreement, you agree to the price of that job ad as at the time of posting (including any applicable discount) being charged to you. For posting ads pursuant to an Ad Budget purchased in your Agreement, see below.
SEEK Ad Types
  1. Classic Ads
    1. A Classic Ad is SEEK’s standard job ad. A Classic Ad entitles you to:
      1. when a Classic Ad is included within a candidates’ search results, the relevant role title for the ad and a brief description of the position you are advertising being displayed to candidates; and
      2. when selected by a candidate from SEEK’s search results, the full contents of the job ad being displayed to the candidate.
    2. From time to time SEEK may repost your Classic Ad on the website/s of its related bodies corporate to increase the exposure of your ad.
    Classic Ad Pricing
    1. Classic Ads are variably priced based on a number of factors, including the supply of and/or the demand for candidates for the role being advertised as well as the average salary and location of that role. Changes to these and other factors may cause the price of an ad to go up or down from time to time.
    2. Once posted, if you edit the role title, category or location applicable to a Classic Ad, the price of that ad may change. If the change results in a job ad price greater than what you were originally charged for your Classic Ad, the difference will either be:
      1. charged to you separately when the changes are made – if the original ad was posted as a single ad not pursuant to an Agreement; or
      2. deducted from the amount of your Ad Budget committed to in your Agreement – if the original ad was posted pursuant to an Ad Budget (if the edited ad is an ‘Additional Ad’ posted pursuant to an Ad Budget (as that term is defined in your Agreement), you will be charged for the difference in the next invoice you receive under your Agreement).
    3. Other than changes to role title, category or location, your Classic Ad can be edited free of charge.
  2. StandOut Ads
    1. A StandOut Ad listing entitles you to the features of a Classic Ad listing plus the following when a StandOut Ad is included within a candidates’ search results:
      • up to three Text points - “selling points”;
      • your logo at the right-hand side of the ad (provided you have submitted an electronic version of your logo for those purposes); and
      • a border around the ad summary when it appears in the search result (defined as a “StandOut Ad”).
    2. You must provide SEEK with the necessary materials and information (outlined above) required to publish the StandOut Ad on the commencement date of the ad. Failure to do so will result in the ad being published as a Classic Ad but you will be charged the StandOut Ad price.

    StandOut Ad Pricing
    1. StandOut Ad prices are comprised of the price of a Classic Ad at the time of posting and a fixed StandOut upgrade fee. If you are posting a StandOut Ad pursuant to an Agreement, the upgrade fee will be specified in your Agreement. For more information on the pricing of Classic Ads, see above.
    2. The editing rules in clause 9 above apply to edits to StandOut Ads.
  3. Premium Ads
    1. A Premium Ad listing entitles you to the features of a Standout Advertisement plus the following increased exposure of your ad.
    2. During the period that a Premium Ad is live on the Site SEEK takes various measures to increase the exposure of your Premium Ad with the aim of obtaining on average applications which would be received for your ad over a 30 day period if it was a StandOut Ad. Ad Budgets
  1. By agreeing to purchase an Ad Budget you are committing to pay SEEK the amount of your Ad Budget set out in your Agreement over the Contract Period (as those terms are defined in your Agreement), regardless of whether or not you have utilised the full value of your Ad Budget.
  2. Your Ad Budget allows you to post any of the ad types specified in your Agreement at any time during the Contract Period until you have exhausted the dollar amount for the Ad Budget within your Agreement without the need to commit any additional spend. For more information on each job ad type, see below.
  3. If you have used the entire amount of your Ad Budget prior to the end of the Contract Period, you may post Additional Ads (as that term is defined in your agreement) at the rates set out in your Agreement until the end of your Contract Period. If you have the value of less than 1 full job ad remaining in your Ad Budget (i.e. you have a fraction of an ad remaining), you will be able to use this remaining dollar amount towards any Additional Ad purchase prior to the end of your Contract Period and you will be invoiced for any shortfall.
  4. Any unused Ad Budget amount (including any amount which may constitute a fraction of an ad) that is not used prior to the end of the Contract Period will expire and cannot be rolled over into a subsequent agreement.
  5. The price of posting a job ad at any point in time (including any applicable discount) is available to you:
    1. For hirers posting via SEEK’s Advertiser Centre, at the point of posting as part of your job ad posting process; or
    2. For hirers posting via other means, using the following link and your SEEK Advertiser Centre login details – https://talent.seek.com.au/account/ad-price-lookup. (Note: the cost of a job ad may not be displayed at the point of posting if you are not using SEEK’s Advertiser Centre to post your ad).
  6. By posting an ad on the SEEK website (Site), you agree to the price of that job ad, as at the time of posting (including any applicable discount), being deducted from the amount of your Ad Budget committed to in your Agreement.
  7. Your Ad Budget is valid for the term specified as the Contract Period in your Agreement unless concluded earlier as set out in your agreement.
  8. The balance of your Ad Budget remaining at any point in time can be calculated by deducting the value of any job ads posted by you to that point in time as part of your Agreement from the value of your Ad Budget and will be expressed as a dollar amount and be shown in your SEEK Advertiser Centre account and available from SEEK Customer Support.
  9. You’ll be billed for your Ad Budget as set out in your Agreement.
  10. Upon expiry of your Ad Budget and in the absence of a subsequent Ad Budget being purchased, any further ads posted on the Site will be billed at SEEK’s then per unit price for casual purchasers (unless agreed otherwise).
SEEK Contracts and Premium Packs
  1. If your Agreement includes a Premium Ad Budget in addition to your Ad Budget then:
    1. you acknowledge that the Premium Ad Budget amount set out in your Agreement may only be applied towards the purchase of Premium Ads; and
    2. the cost of any Premium Ads posted during the Contract Period will first be deducted from your Premium Ad Budget and once until this amount has been exhausted, the cost of any subsequent Premium Ads posted during the Contract Period will, where your Ad Budget has not yet been exhausted, be deducted from the amount of your remaining Ad Budget, or otherwise, posted as Additional Ads as described in clause 24.
Talent Search and SEEK Profiles
The Talent Search site allows advertiser to search, refine and connect with candidates via a candidate’s SEEK Profile in relation to advertisements placed on the Site.

The following terms apply to Flexible Ad Budget or Branded Ad Budget purchases made via our website https://talent.seek.com.au/. If you have purchased your contract via our Sales Team or signed a written contract, please disregard the below terms.

AGREEMENT TERMS

The following terms (including the Site Terms referred to below) apply to your use of ad products under an agreement purchased via our website. All amounts listed in your contract are exclusive of GST.
Contract Period
  1. The Contract Period commences on the Start Date listed in your agreement and will continue until the End Date listed in your agreement, unless during the term of your agreement you enter into a Queued Agreement in which case your active agreement will expire on the earlier of the End Date listed in that agreement or the date upon which you have consumed the Branded Ad Budget in that agreement. Where: a Queued Agreement means a SEEK advertising agreement that is specified to commence upon expiry of an existing SEEK advertising agreement. SEEK will send an email to you notifying you once the Contract Period has commenced.
Payment
  1. When you select ‘Pay by invoice’ via our website at the point of purchase you will be invoiced on the date of your agreement for the amount of your minimum SEEK investment. Payment is due 14 days from the date of that invoice.
  2. Posting of Additional Ads (as that term is defined below) will be invoiced separately.
Job Ad Rates
  1. A Flexible Ad Budget may be used to post Classic, StandOut and Premium Ads at your discretion.
  2. A Branded Ad Budget may be used to post StandOut and Premium Ads, at your discretion.
  3. Ad prices vary depending on the details of the role being advertised and are subject to change from time to time. It is your responsibility to look up the price of a job ad before posting on the SEEK website.

  4. By posting an ad on the SEEK website, you agree to the price of that job ad, as at the time of posting, being deducted from the amount of your Ad Budget (being your total minimum commitment for job ads under your agreement). For more information regarding our job ad types and consumption of your budget see below and our SEEK Product Terms.
  5. Classic Ads - Classic Ads are variably priced, and subject to change from time to time. The price of a Classic Ad will be the price of that ad at the time of posting less the discount set out in your agreement.
  6. StandOut Ads - StandOut Ad prices are comprised of the price of a Classic Ad at the time of posting and a StandOut upgrade fee. When posting a StandOut Ad, the price will be your relevant Classic Ad price at the time of posting (including a discount listed in your contract), plus an additional fee set out in your agreement.
  7. Premium Ads - Premium Ads are variably priced, and subject to change from time to time. The price of a Premium Ad will be the price of that ad at the time of posting.
  8. Additional Job Ad usage
    In the event that your total spend on SEEK job ad products exceeds the amount of your Ad Budget, additional ads may be purchased at the same discount rates (as applicable) under your agreement until the end of the Contract Period in your agreement (Additional Ads).
    Amounts owing for Additional Ads will be invoiced to you on the first day of the calendar month following the posting of such ads, or if posted in the final month of your agreement, will be invoiced to you upon the expiry of your agreement.
Other Products
  1. Any SEEK products or services not listed in your agreement that are purchased by you will be charged at the per unit price for casual purchasers at the time of purchase and invoiced separately. For more information see our Advertising Terms and Product Terms.
Additional Terms & Conditions for Agreement Terms
  1. Use of the website and the products and services listed in your agreement are governed by these terms and conditions, including the below terms, which are incorporated into and form part of your agreement:
    1. SEEK’s Advertising Terms and Conditions which can be found at undefined/support/termsconditions (Advertising Terms);
    2. specific terms and conditions applicable to individual products and services, which can be found at undefined/support/productterms (Product Terms); and
    3. the specific terms and conditions as published from time to time relating to our Talent Search or Premium Talent Search product (as relevant to your purchase) found at undefined/support/talentsearchofferterms (Talent Search Terms).
    For the purposes of your agreement, these terms are collectively known as the "Site Terms". If there is any conflict between the terms of your agreement and the Site Terms, to the extent of any inconsistency the terms of your agreement will prevail. The terms and conditions of your agreement together with the Site Terms (the Agreement Terms) constitute the entire agreement between you and SEEK. By posting ads on our Website or accessing the products and services listed in your agreement you acknowledge that you have read and understood all of the Agreement Terms and agree to be bound by them.
  2. The Agreement Terms may not be amended without our consent. Requests to change the Agreement Terms must be made in writing to your SEEK representative. If an amendment to the agreement is granted, we will notify you in writing.
  3. Where you have selected to ‘pay by invoice’ for your minimum SEEK investment, or you are invoiced for Additional Ads posted during the Contract Period, our standard payment terms are 14 days from the date of invoice. Please refer to the Site Terms for further information regarding payments.
  4. You irrevocably authorise SEEK, its servants and agents to make such enquiries as they deem necessary to investigate your credit worthiness from time to time. You authorise the disclosure to SEEK any such information concerning you in relation to the assessment of your credit worthiness, risk and solvency. We may refuse to grant credit if any information to which we are entitled is not provided.
  5. SEEK reserves the right to reject advertisements for positions located outside of Australia. If you post an advertisement for a position outside of Australia in breach of this clause, you will be charged our then applicable standard casual rate.
  6. If you intend to discontinue using our services at the expiry of the term of your agreement, you must notify us in writing of your intention to do so seven (7) days prior to the expiry of the Contract Period. If you do not sign a new agreement or terminate your agreement with us and you continue to use our services beyond the expiry of Contract Period, then your agreement will automatically continue on the same terms for one (1) calendar month (Rollover Period) and you will be able to access the discount rates set out in your agreement. Your minimum SEEK investment will not be increased during any Rollover Period. After the expiry of the Rollover Period, any products purchased will be charged to you at our then applicable casual advertising rates.
  7. You will be bound from the date of your agreement and are obliged to pay your minimum SEEK investment amount set out in your agreement regardless of whether or not you utilise the full value of the products you have purchased during the Contract Period or SEEK terminates your agreement in accordance with the Agreement Terms.
