A more seamless experience for all our customers – Updates to our online terms

We operate across Australia, New Zealand, Hong Kong and Southeast Asia markets under the brands SEEK, Jobstreet and Jobsdb. We are making changes to combine the markets in which we operate into a single online technology platform.

For our Australia & New Zealand customers, your SEEK experience will largely remain the same. However, from on or around 15 October 2023 there will be some updates to our Advertising Terms of Use, other Terms & Conditions and Privacy Policy to support the changes, improve data security and make our terms easier to understand and more consistent.

Many of the updates will not be relevant to you unless you access the new or expanded products / services that will be available through the new platform. For example, there will be specific terms that only apply where you post an ad for a role located outside of Australia.

We encourage you to read the updated terms and Privacy Policy in full before they come into effect. To assist, we have prepared a summary of the key changes, links to all updated terms, and FAQs.

Historical data retention

To improve data security, we will be revising our approach to data retention for historical application data (which includes resumes, cover letters and other application documents) and job ad data (“Historical Data”) accessible through SEEK Employer accounts. Under the new policy, Historical Data will only be accessible for a three-year period starting from the date: (a) an application is received (in the case of candidate application data); or (b) a job ad is posted (in the case of job ad content). We will be implementing this change from 31 March 2024, noting that any Historical Data that is already older than three years will no longer be accessible after this date. Hirers must transfer any required Historical Data to their own external systems before that date if they need a copy.

If you wish, you can download this data for safekeeping before 31 March 2024 by doing the following:

1. Access historical applications via the Candidate Management platform and select ‘View Details’ (circled in red below)

2. Navigate to the tab for the information you would like to download (e.g. Resume or Cover Letter) and click the ‘Download Document’ icon

Other key changes to the Advertising Terms of Use:

  • We have included ’fair use’ terms to prevent improper use of our updated Asia-Pacific (APAC) employment marketplace.

  • Please be aware that the laws of other countries may apply to you when using the APAC employment marketplace. For example:

    • If you access the personal information / data of a candidate from another country, you must comply with the privacy laws of that country as if you were regulated by such privacy laws.

    • Hiring Filipino based candidates for roles located outside that country may be regulated.

  • As per our previous Advertising Terms of Use, further obligations apply to you if you are utilising an API solution. Please be aware that the revised API related terms will apply to both you and your API partner (if applicable). A link to these updated API terms can be found within the Advertising Terms of Use (see link above). If you directly access our APIs without the use of an API partner, we will contact you separately with further information.

  • Our products and services (and their respective terms) will vary according to location. We encourage hirers to review the terms applicable to their country and other locations that may be relevant (e.g., if a hirer posts an ad for a role located in another country).

  • The updated terms better reflect the products and services we offer, both now and in the future as an APAC employment marketplace.

  • Further country specific product terms will be added over the coming months as the expansion of the APAC employment marketplace rolls out. Those updated terms will also apply to hirers if they use products and services related to those countries.

  • We have taken the opportunity to refresh the terms to make them easier to understand.

  • These terms have been updated to facilitate an APAC employment marketplace and simplified for easier understanding.

  • We will be simplifying our Privacy Policy and aligning it across our three brands (SEEK, Jobstreet by SEEK and Jobsdb by SEEK).

  • We want to make sure that you understand how your information is collected, used, and protected when you use our services.

  • These terms have been updated to facilitate an APAC employment marketplace and simplified for easier understanding.

SEEK operates across six markets throughout Asia under the Jobstreet and Jobsdb brands – Malaysia, Singapore, Hong Kong, Indonesia, Philippines and Thailand.

Jobsdb is a SEEK Group brand that operates an online employment marketplace in Hong Kong & Thailand.

Jobstreet is a SEEK Group brand that operates an online employment marketplace in Malaysia, Singapore, Philippines and Indonesia.

These changes will take effect on or around 15 October 2023.

We encourage you to review the updated Advertising Terms of Use, other Terms & Conditions and Privacy Policy before 15 October 2023.

If you wish to keep historical application and job ad data stored in your SEEK Employer account that is more than 3 years old, please take the steps provided above before 31 March 2024.

There are some important reasons for implementing a 3-year data access period for applications:

  • It improves data security for both you and the candidates that have applied to your previous roles; and

  • We have conducted research that confirms that very few hirers access applications that are older than 3 years.

We appreciate that some hirers may like to retain some historical applications for safekeeping. If you would like further information on how to download historical applications, please see our guidance set out above.

As you will see, we have a new section titled “Fair use and appropriate conduct” (starting at clause 62 of the Advertising Terms of Use). This section has been included for a few reasons:

  • To clearly outline key situations in which we may need to take action to protect our candidates, other hirers and the SEEK Group (for instance, if there is a security threat). We must be reasonable in making any decisions.

  • Our single online technology platform will provide the benefit of posting ads for roles located in other countries across our APAC employment marketplaces. However, we still expect that hirers will post the vast majority of their roles in their contracting country, which is reflected in clauses 63 and 64.

  • We expect all hirers to use our products and services in the way we intend. In the event this does not happen, we will notify the hirer of the improper use (if that is appropriate). If the hirer continues to improperly use our products and services, we are able to take steps to remedy and prevent the improper use.

  • Reinforcing that inappropriate conduct towards our staff has never been acceptable and won’t be tolerated.

  • We have included a right for you to dispute any of the decisions we make under these clauses and we are required to consider your dispute promptly and in good faith.

These changes are necessary to reflect how our improved and expanded service will work. It is important to emphasise that our changes to the terms are fundamentally positive changes needed to facilitate an improved service. For our Australia customers, your SEEK experience will largely remain the same. Many of the updates will not be relevant to you unless you access the new or expanded products and services that will be available through the new platform. For example, there will be specific terms that only apply where you post an ad for a role located outside of Australia.

If you don't agree with the updated terms, you can close your account with us. If you want to close your account, you can do so by contacting your SEEK Account Manager or Customer Service team. Please be aware that you will not be entitled to a refund or other compensation if you decide to close your account given the nature of the changes to our terms.
